A deposition is not held in a courtroom

There is no bench, no gallery and no judge to keep order, which changes what the recording sounds like. Two attorneys, a witness and a reporter sit around a table, and the session can run for six hours with breaks that nobody announces. A deposition transcript built from that file has to survive the flatness of it. Very little marks the passage of time beyond the clock.

Objections at a deposition are usually about form

Counsel rarely argue the substance of a question in front of a witness. What gets said is a short phrase, often no more than objection to form, followed by the instruction to answer. Those three words carried the weight of the exchange, and a deposition transcript that drops them leaves the reader guessing why the witness paused.

Exhibit numbers are read aloud for the record

Before a document is shown to a witness, someone reads its number into the recording: defense exhibit four, marked for identification. Nothing else in the file tells a later reader which document was being discussed. Keeping those spoken markings in the text is what makes a deposition transcript usable against the exhibits themselves. A written index built afterwards misses them.

A witness who pauses before answering a simple question has told both sides something. Filler words and half-finished sentences are left in place for that reason, and a reading pass is where the sense gets made. Smoothing the language would erase the very detail a deposition transcript exists to record. So does the flat way a denial can be delivered.
